Plant Health and Growth:
Plants are living things—we do our best to provide healthy plants, but we can’t guarantee they’ll thrive in every garden. Plant success depends on soil, weather, care, and growing conditions that change after you take them home. We’re not responsible for plants that don’t grow as expected once they leave our care. However, we’ll be happy to help you figure out what might be going wrong and guide you toward solutions that could help your plants succeed in the future.
Seasonal changes—Plants look different throughout the year. That beautiful flowering plant in spring might be dormant in winter, and that’s completely normal.
Size variations—Plants grow at their own pace. The size you see today might be different from what’s available next week—that’s just how Mother Nature works.
NC climate considerations – Our North Carolina weather can be unpredictable. We can’t be held responsible for plant loss due to unexpected freezes, heat waves, drought, or storms.zz
Product Information and Vendor Liability:
Manufacturer product labels—We carry products from many different suppliers and manufacturers. While we try to stay informed, we’re not responsible for the accuracy of information on product labels, packaging, or care instructions provided by manufacturers. Always read and follow the manufacturer’s directions carefully.
Chemical and fertilizer information—Product effectiveness and safety information comes from the manufacturers. We’re not liable for results or issues that arise from following manufacturer instructions.
Product formulation changes—Sometimes manufacturers change their products without letting us know first. We’ll do our best to keep you updated, but we can’t guarantee products will always be the same as before.
Delivery and Bulk Materials:
Delivery measurements—When we deliver bulk materials such as soil, mulch, sand, or gravel, we measure by the scoop or truckload. Some variation in the exact amount is normal due to how materials settle during transport and the nature of bulk delivery. We aim to be as accurate as possible, but perfect measurements aren’t always possible.
Scoop size variations—Our scoops hold approximately the same amount each time, but natural materials don’t pack identically. A scoop of dry mulch takes up different space than wet mulch.
Delivery access—We need safe, accessible routes to deliver bulk materials. If our truck can’t safely reach your delivery location, we might need to dump materials at the closest accessible spot.
Natural material variations— Materials like mulch, topsoil, and stone vary in color, texture, and composition. That’s the nature of natural products – no two loads are identical.
Weather-related delays—We might need to postpone deliveries during severe weather for safety reasons or to protect material quality.
Chemical Products and Fertilizers:
Proper usage responsibility—You’re responsible for using all chemicals, fertilizers, and treatments safely and according to manufacturer instructions. We’re not liable for damage, injury, or poor results from improper use.
Results are not guaranteed—fertilizers, pesticides, and treatments work differently depending on soil, weather, and plant conditions. We can’t promise specific results from any product.
Organic product claims—When we label something as organic, we’re relying on our supplier’s certification. We don’t independently test every organic product.
Store Safety and Customer Responsibility:
Shopping safety—Please watch your step around our facility. Garden centers have uneven surfaces, water, heavy items, and equipment that could cause injury if you’re not careful.
Heavy lifting—Many garden products are heavy. Please ask for help loading, and lift safely to avoid injury. We’re not responsible for injuries from lifting or moving products.
Children and pets—Please supervise children and pets while shopping. Some plants and products can be harmful if eaten, and there are safety hazards throughout the store.
Allergic reactions—Some people are sensitive to plants, mulch, fertilizers, or other garden products. If you have known allergies, please take appropriate precautions.
Returns and Warranties:
Plant returns—We’ll work with you if you have problems with plants, but we need to see the plant and have your receipt. We can’t accept returns on plants that have been in the ground.
Bulk material returns— Sorry, we can’t take back soil, mulch, gravel, or other bulk materials once they’ve been delivered. Please measure your space carefully before ordering.
Sale and clearance items—Discounted and clearance items are typically final sale unless there’s a genuine defect with the product.
Warranty limitations—Any warranties we offer, if any, are limited to replacement of defective products and don’t cover consequential damages or losses.
Pricing and Availability:
Price changes—Garden supply prices fluctuate with seasons, weather, and market conditions. We update prices regularly, but there may be delays between supplier price changes and our updates.
Stock availability—We try to keep popular items in stock, but high-demand products sell out quickly, especially during peak gardening seasons.
Advertised items—If we’re out of an advertised item, we’re happy to provide a rain check for the sale price when possible.
General Business Terms:
Acts of nature—We’re not responsible for problems caused by events beyond our control, including severe weather, natural disasters, supplier issues, or other circumstances that make normal business operations impossible.
Advice and recommendations —Our staff shares knowledge based on experience and general gardening practices. Not all of us are certified horticulturists or soil scientists. Use our advice as a starting point for your own research.
Photography and descriptions—Photos on our website or in advertisements are meant to show what products typically look like, but actual items may vary in color, size, or appearance.
NC regulations compliance—We operate under North Carolina Department of Agriculture regulations for nursery operations and maintain appropriate certifications for selling plants and garden products.
Limitation of Liability:
Damages limitation—Our liability is limited to the purchase price of products sold. We’re not responsible for indirect damages, lost profits, or consequential losses related to products.
Time limits—Any claims must be made within a reasonable time after purchase. We can’t address problems that are reported months after purchase.
